RSVPme is a product of Apex Web Systems LLC.
Welcome to RSVPme. These Terms of Service ("Terms") govern your use of the RSVPme website at rsvp-me.app, operated by Apex Web Systems LLC ("RSVPme," "we," "us," or "our"), and all related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.
1. Acceptance of Terms
By creating an account or using the Service, you confirm that you are at least 18 years old and agree to comply with these Terms. If you do not agree to these Terms, you may not use the Service. We reserve the right to update these Terms at any time, and your continued use of the Service constitutes acceptance of any changes.
2. Service Description
RSVPme is an event invitation platform that allows hosts to:
- Upload photos or images of physical invitation cards.
- Use AI-powered card reading to extract event details.
- Create digital RSVP pages featuring their invitation card image.
- Add a guest list with phone numbers.
- Send personalized SMS invitations to guests via text message.
- Track RSVP responses in a real-time dashboard.
- Send reminder messages to guests who have not responded.
3. User Responsibilities
As a host using RSVPme, you agree to the following:
- Consent to contact: You confirm that you have an existing personal relationship with each guest whose phone number you add, and that you have reasonable consent to contact them about your event via text message.
- Accurate information: You will provide accurate event details and correct phone numbers for your guests.
- Account security: You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
- Lawful use: You will use the Service only for lawful purposes and in accordance with these Terms.
- Guest data: You are responsible for ensuring you have the right to share guest contact information with our platform for the purpose of sending event invitations.
4. Payment Terms
- Per-event pricing: We charge a one-time fee per event, based on the number of guests in your plan (Starter, Most Popular, or Celebration tier).
- Payment timing: Payment is required before SMS invitations are sent to your guest list.
- Non-refundable after send: Once SMS messages have been delivered to your guests, the event fee is non-refundable, as SMS delivery costs are incurred immediately.
- Refunds before send: If you have paid but have not yet sent invitations, you may request a full refund by contacting us.
- Payment processing: All payments are processed securely through Stripe. We do not store your full payment card information.
5. SMS Opt-In Disclosure
We send text messages to guests on behalf of event hosts. Our SMS practices are as follows:
- Who receives messages: Only guests whose phone numbers are voluntarily added by event hosts who confirm an existing relationship.
- Message content: Messages contain event invitation details and a unique RSVP link. No marketing, advertising, or promotional content is sent.
- Message frequency: Guests typically receive 1-3 messages per event (invitation plus optional reminders).
- Opt-out: Any guest can reply STOP at any time to immediately stop receiving messages from RSVPme. Once opted out, no further messages will be sent to that number.
- No sharing: Guest phone numbers are never sold, shared with third parties for marketing, or used for any purpose other than delivering event-related messages.
6. Prohibited Use
You may NOT use RSVPme to:
- Send spam, unsolicited messages, or bulk marketing communications.
- Contact people you do not personally know or who have not given you their number.
- Promote commercial products, services, or businesses (the Service is for personal event invitations only).
- Send messages containing illegal, threatening, harassing, or harmful content.
- Upload fraudulent or misleading invitation content.
- Attempt to circumvent SMS opt-out requests or re-add opted-out numbers.
- Use automated systems to create accounts or submit guest lists.
- Reverse-engineer, decompile, or attempt to extract the source code of the Service.
Violation of these rules may result in immediate account termination without refund.
7. Intellectual Property
- Your content: You retain ownership of invitation images and event content you upload. By uploading, you grant RSVPme a limited license to display your content to your invited guests and to process it through our AI card-reading system.
- Our platform: The RSVPme name, logo, design, and underlying technology are our intellectual property and may not be copied or reproduced without permission.
8. Limitation of Liability
To the maximum extent permitted by law:
- The Service is provided "as is" without warranties of any kind, express or implied.
- We do not guarantee that SMS messages will be delivered to every recipient, as delivery depends on carrier networks, phone status, and other factors outside our control.
- We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
- Our total liability for any claim related to the Service shall not exceed the amount you paid to Apex Web Systems LLC in the 12 months preceding the claim.
- We are not responsible for the accuracy of AI-extracted event details; hosts are responsible for verifying information before sending.
9. Account Termination
We reserve the right to suspend or terminate your account if you violate these Terms, engage in prohibited use, or if we reasonably believe your activity harms our platform or other users. You may also delete your account at any time from your dashboard settings.
10. Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be resolved in the courts of Delaware. The legal entity responsible for the Service is Apex Web Systems LLC.
